(i) where the practice of a government involves a direct transfer of funds (e.g., grants, loans and equity infusions) or possible direct transfers of funds or liabilities (e.g., loan guarantees);
(1) In accordance with the provisions of Article XVI of GATT 1994 (Note to Article XVI), and the provisions of Annexes I to III of this Agreement, the exemption of an exported product from duties or taxes borne by the like product when destined for domestic consumption and the remission of such duties or taxes in amounts not in excess of the total amounts due or paid shall not be deemed to be a subsidy.
1.2 A subsidy, as defined in paragraph 1, shall only be subject to the provisions of Part II or to the provisions of Part III or V where it is specific under the provisions of Article 2.
2.1 In determining whether a subsidy as defined in paragraph 1 of Article 1 is specific to an enterprise or industry or group of enterprises or industries (referred to in this Agreement as “certain enterprises”) within the jurisdiction of the granting authority, the following principles shall apply:
I On July 21, 2006, the Council of Ministers approved Royal Decree 887/2006, approving the Regulations of Law 38/2003, the General Subsidies Law. With the approval of both regulations, the framework to which, by virtue of the basic nature of many of its precepts, the management of subsidies granted in our country must be adapted was established.
After the approval of the regulations, the process began which led to the approval by the Galician Parliament of Law 9/2007, of June 13, 2007, on subsidies in Galicia, which adapts to the peculiarities of the management of subsidies in our community. Law 9/2007, published in the Official Gazette of Galicia on June 25, 2007, came into force after a three-month vacatio legis. In its final provision, it mandates the executive to draw up and approve a regulation to develop it for its application. In compliance with this mandate, these regulations have been approved.
The structure of the regulation follows the lines marked by the preceding regulation, resembling the structure of the regulation that develops the General Law on Subsidies. The regulation is structured in six titles containing 87 articles, four additional provisions, one derogatory provision and two final provisions.

d) That she is not involved in any of the cases provided for in Article 13.2 of Law 38/2003, of November 17, with the exception of the provisions of letter e) and g), so that she may obtain the status of beneficiary of the aid even if she is not up to date in the fulfillment of obligations for the reimbursement of subsidies, tax and Social Security.

The aids will be granted by direct concession, under the protection of the provisions of article 22.2.b) of Law 38/2003, of November 17, 2003, General Law on Subsidies, and article 75.2.b) of the Law of Finance of Castilla-La Mancha, according to the fulfillment of the requirements that justify their granting.
